1. Purpose

Numidia AI is an online service that allows you to generate advertising videos and images using artificial intelligence, from generated avatars, products provided by the user, and scripts or prompts written by the user or assisted by the artificial intelligence integrated into the service.

The service is operated by **Dune Automate Inc.**, whose registered office is located at 1055 Rue Lucien-L'Allier, Unit #1036, Montreal, QC H3G 3C4, Canada (see the Legal notice).

2. Access to the service

Access to Numidia AI requires the creation of an account. A free base of credits is offered upon registration. Full access to features and larger credit volumes requires a paid subscription, according to the plans displayed on the subscription page at the time of subscription.

3. Credit system

Each image or video generation consumes a number of credits determined by the artificial intelligence model used, the duration, the resolution, and the additional features employed, as indicated before each generation. Credits included in a subscription are renewed with each billing cycle and cannot be carried over beyond one period, unless otherwise stated. Credits already consumed in a successful generation are not refundable. In the event of a technical failure of a generation attributable to the service, the corresponding credits are automatically refunded to the user's account.

4. Acceptable use

The user undertakes not to use Numidia AI to create illegal, defamatory, fraudulently misleading content, content infringing the rights of a third party, or content intended to impersonate a real person without their consent. The user is solely responsible for the products, images, avatars and texts that they import or generate through the service, and warrants that they hold the necessary rights to any content they upload.

5. Ownership of generated content

Subject to compliance with these terms, the user holds the exploitation rights over the videos and images they generate through Numidia AI, within the framework of their active subscription. Dune Automate Inc. reserves the right to use anonymized generations for the purpose of improving the service, unless expressly opposed by the user.

6. Limitation of liability

Numidia AI is provided as is. Dune Automate Inc. does not guarantee the absence of errors, interruptions, or results perfectly faithful to the user's expectations, artificial intelligence generation involving an inherent degree of variability. Dune Automate Inc. declines all liability for the user's use of the generated content, in particular its public or commercial distribution.

7. Termination

The user may cancel their subscription at any time from their account management area, without commitment or notice. Cancellation takes effect at the end of the current billing period. Dune Automate Inc. reserves the right to suspend or terminate an account in the event of a violation of these terms.

8. Conditions of sale and refund policy

8.1 Billing

Subscriptions are billed recurrently, monthly, via our payment provider Stripe, at the rate displayed on the subscription page at the time of subscription. One-time credit purchases are billed once at the time of purchase.

8.2 Refunds

Credits consumed as part of a successful generation are not refundable. In the event of a payment dispute or refund request processed by Stripe, the credits corresponding to the refunded amount are removed from the user's balance. Subscriptions may be cancelled at any time at no cost for the future, but the period already billed is not refunded on a pro rata basis, unless a contrary legal provision applies in the user's jurisdiction.

8.3 No commitment

Numidia AI subscription plans are without any duration commitment and may be cancelled at any time from the account management area.

The use of your personal data is governed by our Privacy policy.
